- Introduction
Welcome to Riviera Gourmet. These Terms and Conditions govern your use of our services, including the ordering, delivery, and provision of food, beverages, and other goods to super yachts globally. By placing an order with us, you agree to be bound by these Terms and Conditions. - Definitions
- “Riviera Gourmet” refers to the company providing the goods and services.
- “Customer” refers to any individual, company, or entity placing an order with Riviera Gourmet.
- “Goods” refers to all items offered for sale by Riviera Gourmet, including but not limited to food, beverages, and other yacht supplies.
- “Services” refers to the ordering, delivery, and provision of goods by Riviera Gourmet.
- Ordering
- Orders can be placed via phone, email, or other agreed-upon methods.
- Customers are responsible for providing accurate and complete order details, including the type and quantity of goods, delivery location, and desired delivery date and time.
- Riviera Gourmet reserves the right to refuse or cancel any order at its discretion.
- Confirmation of an order by Riviera Gourmet does not guarantee delivery if unforeseen circumstances arise.
- Pricing and Payment
- Prices for goods and services are subject to change without notice.
- Unless otherwise agreed, prices are quoted in Euros (€) and are exclusive of any applicable taxes, duties, or shipping costs.
- Payment terms are as agreed upon between Riviera Gourmet and the customer. Typically, this includes payment within 14 days of receiving the invoice. A 2% late fee will be applied weekly to any outstanding balance after this period.
- Riviera Gourmet accepts various payment methods, including bank transfers, credit cards, and other agreed-upon methods.
- Delivery
- Riviera Gourmet will make every effort to deliver goods within the agreed-upon timeframe. However, delivery times are estimates and are not guaranteed.
- Customers must provide a suitable delivery location and ensure that someone is available to receive the delivery.
- Risk of loss or damage to the goods passes to the customer upon delivery.
- Riviera Gourmet is not liable for delays or failures in delivery caused by events beyond its reasonable control, including but not limited to weather conditions, customs delays, or transportation strikes.
- Additional charges may apply for deliveries to remote or difficult-to-access locations.
- If the vessel is not available to receive the order as planned and Riviera Gourmet is waiting in port or at a pre-organized destination unable to deliver due to the customer’s changes, a 60-euro hourly waiting fee will be added to the invoice. Conversely, if Riviera Gourmet is late in delivering the order, a 60-euro hourly late delivery fee will be deducted from the invoice. (This does not apply to export orders or long-distance orders.) You can’t say we are not fair!
- Non-Cancellable Items and Cancellations
- Items ordered specifically for the yacht in advance cannot be cancelled. Clients are liable for full payment of these items, even if the owner or charter guest cancels the charter.
- If an order is cancelled, Riviera Gourmet will make every effort to cancel items where possible. However, specifically prepared items (e.g., fish, meat) and online-ordered items cannot be cancelled and will be charged to the client.
- Export Orders (Outside of EU, Including French and other EU Country Overseas Territories)
- All export orders are final 8 days before the estimated delivery date. After this time, no changes can be made, and Riviera Gourmet holds no responsibility for items arriving in poor or unusable condition if changes are made.
- If the export destination needs to be changed, cancellation fees will be applied to cover costs such as cancelled booked flights. These fees will be added to the final invoice.
- Riviera Gourmet is not responsible for:
- Orders held in customs. All associated costs will be passed onto the yacht.
- Export orders bumped to later flights. No refunds will be provided for items that arrive in poor or unusable condition due to delays.
- For delicate fruits and vegetables (e.g., salad leaves, berries, and aromatics), it is common for up to 10% of these items to become unusable after transportation. This is an accepted consequence of exporting food produce from Europe, and no discount or refund will be provided for this expected loss.
- If destination or delivery dates are changed after the initial booking, Riviera Gourmet will do its best to accommodate these changes, but they cannot be guaranteed. The yacht remains responsible for all associated costs, including item cost, shipping, and handling, even if the export order results in a total loss.
- Quality and Returns
- Riviera Gourmet is committed to providing high-quality goods and services.
- If the customer receives goods that are damaged, defective, or not in accordance with the order, they must notify Riviera Gourmet within 4 hours of delivery.
- Riviera Gourmet will, at its discretion, provide a replacement, refund, or credit for the affected goods.
- Due to the perishable nature of many of our goods, returns are generally not accepted unless the goods are damaged or defective upon delivery.
- Riviera Gourmet is only responsible for the delivery condition to the side of the yacht. How the crew handles the product, including decanting from our color-coded crates to the vessel’s crates, is not our responsibility. Handling products in this manner can bruise them, and the temperature change inevitable during this process may cause issues that only become apparent the next day or two. Riviera Gourmet is not liable for this, and all Head Chefs should be aware of this reality and train deck crew accordingly.
- Crew must also be aware that any delay in moving the product from the dock to temperature-controlled areas onboard will reduce the life of the product. Riviera Gourmet will not be held accountable for this. Once the product has left the hands of Riviera Gourmet and been checked by the Head Chef, this is considered the end of the delivery. Unless poor quality is noticed at this point and brought to our attention immediately, Riviera Gourmet will not be responsible at a later date.
- Riviera Gourmet takes temperature control and handling extremely seriously, adhering to a dedicated Health and Safety procedure. We are independently inspected up to three times a year by the local health board to ensure the highest standards are maintained by our team of trained professionals.
- Liability
- To the maximum extent permitted by law, Riviera Gourmet’s liability for any loss or damage arising out of or in connection with the supply of goods and services is limited to the purchase price of the goods or services in question.
- Riviera Gourmet is not liable for any indirect, consequential, or incidental damages, including but not limited to loss of profits, loss of use, or business interruption.
- Customs and Import/Export Regulations
- Riviera Gourmet complies with applicable customs and import/export regulations. However, customers are responsible for ensuring compliance with their destination’s import/export requirements.
- Riviera Gourmet is not liable for delays, fines, or additional costs incurred due to customs inspections or regulatory issues.
- Governing Law
- These Terms and Conditions are governed by and construed in accordance with the laws of France.
- Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of France.
- Amendments
- Riviera Gourmet reserves the right to amend these Terms and Conditions at any time without notice.
- The latest version of the Terms and Conditions will be available on our website or upon request.
